If I have my freezer in the first slot and someone steals on the first slot ... do they get to use it??

Yes, why wouldnt they be? unless its species
If you use the freezer (or any once per battle item) the same turn they steal it, they will waste their stealer and not be able to use the item that they stole.
Otherwise, if they steal if and you did not use it the same turn, they can use the stolen item.

Which makes you vulnerable to late-freezing, so don't fight any lab-rats or super tanks.
Furthermore, putting an expendable item in the first slot means you still have to worry about what could get stolen from the second slot - you're not solving the problem, just moving it from round 1 to round 3.
Personally I'm a fan of "shield against icons you don't deal" as the stealable item, but you can also use a "constant you can easily defend against" - in both cases you have a weapon you can still use, and in both cases it is of only minimal use to an opponent who steals it.
