there are some who will use a known javascript glitch, and get frozen for doing it. It's the same one people use to fight the fairy for her avatar without buying a piece of merchandise or atleast using a code from merchandice.

You can't fight the Space Faerie unless you unlock her, meaning using the correct redemption code. Of course, you don't have to buy one if somebody gives you a code, so I don't see how that would be illegal.
If what you're saying is true, then anybody can challenge any opponent, which isn't the case. If TNT really did want everybody to stop fighting normal challengers, I'm sure they can fully disable them instead of removing them from the list. It's NOT a glitch. It's simple javascript.

Key word in your statement being CAN. It wouldn't be overly hard to do it if you know how to mess with Java...I wouldn't do it, as i'm not an expert at Java, nor would I do something like that anyway...

Neither am I, yet I'm sure anybody with a little bit of resourcefulness (I mean, all you need to know how to do is examine a link and copy/modify it) and you have access to it. I figured it out on my own years ago.
My take on it is that TNT left them wide open when they could disable them if they wanted to, making them the ones at fault. There's nothing that everybody can easily see that says "DON'T CHALLENGE THE OLD CHALLENGERS USING JAVASCRIPT OR ELSE U GETZ FROZEN!!!!111"
